L’ERBOLARIO products are imported from Italy by Primex International Marketing. “We,” “us,” and “our” refer collectively to The Mustard Tree International Pty Ltd (Via Delle Erbe), unless otherwise stated to refer to Primex International Marketing.

These Terms and Conditions apply solely to retail customers purchasing for personal use. They do not apply to authorized stockists or wholesale retailers.

1. Website Use & Cybersecurity

By accessing and using this website (hosted on WIX.com), you agree to comply with these Terms and Conditions. If you do not agree, you must cease using this site immediately.

• Accuracy: While we endeavor to ensure all website information is accurate, occasional technical, typographical, or printing errors may occur. We do not warrant that all online material is error-free.

• Availability: We do not guarantee uninterrupted access to this website and will not be liable if the platform is temporarily unavailable due to server maintenance or external issues beyond our control.

• Prohibited Use: You must not misuse this website, knowingly introduce malicious software, or attempt to gain unauthorized access to our secure database systems.

2. Products, Stock & Order Acceptance

• Stock Availability: Product listings online do not guarantee immediate stock availability. Our premium items are imported from Italy, and inventory levels may change rapidly. Online listings do not imply an item is currently in our warehouse.

• Out-of-Stock Processing: In the rare event that an item becomes unavailable between purchase and dispatch, we will notify you immediately. You will be provided with the choice of a full refund or a store credit towards alternative products.

• Product Representations: We take care to ensure accurate digital representations of our items. However, we cannot guarantee total color accuracy on your screen. Product names used online may occasionally differ from the original text on the physical Italian packaging.

• Order Cancellations by Us: An order confirmation or receipt does not constitute final order acceptance. We reserve the right to decline or cancel any order prior to dispatch (e.g., if payment is unauthorized, or an item is discontinued by our supplier). If we cancel an order after payment is processed, a full refund will be issued. We will never substitute an ordered item for an alternative product without your prior consent.

3. Pricing & Billing Mistakes

• Currency: All prices are listed in Australian Dollars (AUD). Prices are subject to change at any time without notice. Finalized orders placed prior to a price adjustment or promotional discount will be honored at their original transaction price.

• Pricing Errors: In the event that a product is mistakenly listed at an incorrect price due to an administrative or technical error, we reserve the right to cancel the transaction.

• If you were undercharged: We will cancel the order and provide a full refund of the amount paid. You will be given the option to re-purchase the item at its correct price.

• If you were overcharged: We will automatically correct the error and immediately reimburse you for the difference.

3a. Promotional Codes & Sale Discretion

Promotional codes, discount vouchers, and seasonal coupons (such as EOFY codes) must be applied at the time of checkout prior to payment authorization. Discounts cannot be applied retroactively to an order once completed. Unless explicitly stated otherwise, promotional codes cannot be stacked, combined, or used in conjunction with any other offer in a single transaction. We reserve the right to exclude specific limited-edition collections, gift vouchers, or clearance items from discount promotions.

 

4. Payment Security & Processing

You are responsible for ensuring all payments made to us are complete and authorized. For security purposes, credit card details provided to us over the phone or via our payment gateway are handled with 100% strict confidentiality. To protect your financial data, we request that you never disclose credit card numbers through unencrypted methods such as email. All temporary credit card records are securely destroyed immediately following transaction authorization.

5. Pre-Orders & Back-Orders

When a product is temporarily out of stock, we may offer a "pre-order" or "back-order" option to secure items from our upcoming shipment from Italy.

• We require either full payment or a 50% deposit from retail customers to secure a back-order.

• As these items are imported from Italy, delivery windows are estimates only. Local transit and international shipping times are subject to customs and logistics conditions beyond our direct control.

• Deposits are non-refundable for change-of-mind cancellations. This deposit is legally retained to cover pre-incurred administrative costs, container space allocation, and import/handling fees. If we are ultimately unable to fulfill your pre-order due to permanent supplier discontinuation, your deposit will be fully refunded.

6. Delivery, Shipment & Import Regulations

We ship to retail customers across Australia and New Zealand. No products will be dispatched until full cleared payment has been received.

• Free Postage: Standard road shipping is complimentary for domestic Australian retail orders with a total transaction value exceeding $149 AUD.

• New Zealand Shipping Restrictions: Due to strict international aviation safety regulations regarding flammable liquids, all alcohol-based fragrance items cannot be shipped to New Zealand. We ship skincare, lotions, and non-alcoholic creams to New Zealand via standard international air networks.

• Transit Delays: While we utilize trusted courier networks, we cannot guarantee exact delivery times as courier schedules are outside our direct control. We are not liable to retain physical postage evidence beyond two months after sending an order.

• Import Restrictions: We take no responsibility for issues, delivery failures, or customs seizures that arise if you attempt to import or deliver our products to an area where such cosmetic ingredients or imports are legally prohibited or restricted.

• Transit Damage Risk: We pack our premium glass jars and perfume bottles to strict commercial safety standards. If your package is lost or damaged during transit before it reaches your physical possession, your statutory consumer guarantees are protected under the Australian Consumer Law and New Zealand Consumer Guarantees Act. Please refer to our separate Returns, Cancellations & Faulty Policy to submit a transit claim.

7. Intellectual Property & Information Disclaimer

• Intellectual Property: Primex International Marketing, The Mustard Tree International PTY LTD, and L’ERBOLARIO (Italy) are the exclusive owners of all content displayed on this website and our digital order forms. You may not copy, reproduce, or copyright any material on this website other than in accordance with the Copyright Act 1968 (Cth).
